What’s the difference between real estate sales licenses in New Jersey?

There are four kinds of real estate licenses issued in New Jersey. They are for salespersons, broker-salespersons, brokers, and referral agents.

Differences In Sales And Broker Licenses

The relationship between a broker and the remaining three is much the same as that between a boss and workers. A broker operating his or her own office under state law must supervise and oversee all sales licensees working from that office or on the broker’s behalf.

A broker is the only individual empowered by state law to conduct a real estate transaction. Sales persons have no legal authority to participate in a transaction without their broker’s involvement.

Individuals who hold a New Jersey broker’s license but work in the office of, and on behalf of, another broker are known by the state as “broker-salespersons.” They too are subject to supervision.

Referral agents are limited to referring prospective consumers of real estate brokerage services to their employing broker or broker-of-record. They cannot accept compensation for referrals from anyone other than their employing broker. They must take all pre-licensure education required for licensure, and pass the salesperson or broker-salesperson license examination.

It’s more difficult and takes longer to get a broker’s license.

You must hold a NJ real estate sales license for at specified period of time before you can qualify to become a broker. Then you need to take significantly more education. You need to pass another licensing exam. Unless you intend to work with another broker as a broker-salesperson or referral agent, you’ll need to start up your own office and meet state requirements for it.

Why do I need a license, anyway?

New Jersey state law requires that you obtain a license to assist in the purchase, sale, rental or lease of real estate on behalf of anyone other than yourself. The license is issued by the New Jersey Department of Banking and Insurance, and is supervised by the New Jersey Real Estate Commission.

How young can I be? Or how old?

To qualify for a real estate sales license you must be at least age 18 or older. You also must legally reside in the United States, and be of “good moral character.”

Do I need a high school diploma?

What State Law Requires Of Licensees

State law requires that prospective licensees have a high school education or its equivalent, like a GED certificate. You don’t need a college degree. You also don’t need to be currently employed. Getting a license can lead you into a whole new career, and that’s sort of the point!

If you have a “record …”

The Commission flatly states it “must be satisfied as to the applicant’s honesty, trustworthiness, character and integrity.”

If you have a criminal record, or are currently on parole or probation, be aware that your application for a real estate license may be denied. Before you register for classes, check with the Commission by calling 609-292-8300 Ext. 50135 to ensure your past criminal record will not hinder obtaining a license.

If applicable, you must be up-to-date on court-ordered child support payments.

All New Jersey real estate license candidates must be fingerprinted in a state-approved process. This includes all new candidates for individual real estate salesperson, real estate broker-salesperson, real estate broker, and referral agent licenses.

Fingerprinting also is required of any individual who will serve as an officer, director, member, partner or owner of a controlling interest of a corporation, limited liability company or partnership applying for a license to conduct business as a real estate brokerage company.

How do you qualify for an NJ real estate sales license?
  • Be 18 years of age or older;
  • Have a high school education or its equivalent;
  • Complete a 75-hour pre-licensure course at a state-licensed school (Polley is licensed); and
  • Pass the license examination.
Earning An NJ Real Estate Sales License

After successfully completing the course and passing the examination, the applicant must apply for a license through a sponsoring real estate broker. The New Jersey Real Estate Commission must also be satisfied as to the applicant’s honesty, trustworthiness, character and integrity.

Applicants who have been convicted of a crime, or who currently are on parole or probation, may be denied the ability to apply for a real estate license.

Persons who are citizens of New Jersey and who qualify as disabled veterans of the U.S. Armed Forces may be able to obtain waivers of the license education and experience requirements. Call the Commission’s Education Waiver Section at 609-292-7272, Ext. 50137, for details.

New Jersey does not have license reciprocity with any state.

New Jersey’s Instructions On The Subject

For Pennsylvania-licensed real estate salespersons who wish to obtain a sales license in New Jersey, the New Jersey State Real Estate Commission has issued a one-page guide on the topic (below).

Pennsylvania Licensees
PENNSYLVANIA SALESPERSON WANTS TO
BECOME LICENSED AS A NEW JERSEY SALESPERSON

First Option:

  • Come to New Jersey and take the 75-hour pre-licensure course and follow the normal procedures for licensure.

    This includes:
  • Attend all classes
  • Pass a school final examination
  • Pass the State examination (Candidates must pass both portions of the exam simultaneously, this includes State and National)

Second Option:

  • Received PA License BEFORE the 2018 Rule Change
  1. Take 15 hours of a Broker pre-licensure course in Pennsylvania at a school approved
    by the Pennsylvania Real Estate Commission.
  2. Complete a New Jersey Salesperson Waiver Application
  3. Submit a current Certificate of Licensure from the Pennsylvania Real Estate
    Commission (an original document issued within 30 days)
  4. Attach a transcript certifying the successful completion of the 15-hour Broker course
    (transcripts must state that these credits would be applied toward the Broker
    credits required in Pennsylvania)
  5. Submit a money order or certified check for $25.00 (non-refundable processing fee)
  6. Pass the State examination (Candidates must pass both portions of the exam
    simultaneously, this includes State and National)
  • Received PA License AFTER the 2018 Rule Change
  1. Complete a New Jersey Salesperson Waiver Application
  2. Submit a current Certificate of Licensure from the Pennsylvania Real Estate Commission (an original document issued within 30 days)
  3. Submit a money order or certified check for $25.00 (non-refundable processing fee)
  4. Pass the State examination (Candidates must pass both portions of the exam simultaneously, this includes State and National)
